This is a personal injury action. Plaintiff Richard Cosimini ("Cosimini") was injured at his job site and collected workers' compensation from his employer, Subcontractor Rusco Steel Company ("Rusco"). Plaintiff subsequently sued the general contractor, Atkinson-Kiewit Joint Venture ("Atkinson-Kiewit") who in turn filed a third-party complaint against Rusco.
