OPINION AND ORDER

PETTINE, Senior District Judge.

Pursuant to the Copyright Act of 1976, 17 U.S.C. § 505 and the United States Supreme Court's holding in Fogerty v. Fantasy, Inc., ___ U.S. ___, 114 S.Ct. 1023, 127 L.Ed.2d 455 (1994), the defendants seek attorneys' fees as the prevailing party in this copyright infringement action. For the foregoing reasons, the defendants' motion is denied.
