James Harrison Yeary and Linda Jensen Yeary appeal the district court's ruling that 10,500 shares of stock are not includable in their bankruptcy estate. In granting summary judgment to Sonitrol Financial Corporation (SFC), the court construed an agreement between the parties as constituting a conditional equitable conveyance of the stock to SFC which took effect prior to the Yearys' bankruptcy.
