KELLY, Judge.
In this opinion, we are called upon to determine whether a defendant's trial counsel can be found to have rendered ineffective assistance to his client by failing to request a jury instruction on criminal trespass in a case where burglary is the offense at issue. We hold that trial counsel cannot be found ineffective because criminal trespass is not a lesser included offense of burglary, and thus, a jury instruction thereon would not have been warranted...
