Appellant David J. Killean was convicted after a jury trial of one count of possession of marijuana for sale, a class 3 felony, and one count of transportation of marijuana for sale, a class 2 felony. He was sentenced to mitigated terms of 3.75 years imprisonment and 5.25 years imprisonment for the respective counts, and the sentences were ordered to run concurrently.
