This matter is currently before the court on defendants' motions for summary judgment. For the following reasons, the motion is GRANTED in part and DENIED in part.

F. Lee Weiss ("Weiss") pled guilty to conspiracy to file false income tax returns on May 7, 1992. On July 16, 1992, this court sentenced Weiss to 27 months incarceration...
