Respondent Lars Andersen and Associates, Inc., agent for K-Mart Corporation and Pavia Associates (collectively K-Mart) sought to acquire about twenty-five acres from respondent Embassy Suites, Inc. (Embassy) in order to construct a shopping center. K-Mart applied for special use permits and variances for the construction. The Reno Planning Commission approved the permits and variances.
