Defendants have filed a motion to dismiss the indictment for lack of jurisdiction and for violation of their due process rights for alleged prejudicial interference with the grand jury.1 The Independent Counsel counters that he has jurisdiction by virtue of the conflict-of-interest provision under 28 U.S.C. § 591(c)(2).
