In 1992 defendant Michael Lynn Holmes (hereinafter Michael) was indicted for trafficking in a controlled substance by possession, by sale, by delivery, and by transportation in violation of N.C.Gen.Stat. § 90-95(h)(3)(c). He was also indicted for conspiracy to traffic in a controlled substance in violation of N.C.Gen.Stat. §§ 90-95(1) and 90-95(h)(3)(a).
