This cause comes before the court on plaintiff George Macri, Jr.'s Motion to Dismiss Verified Petition or Motion to Remand to State Court (filed November 22, 1994 (# 4)). Defendants M & M Contractors, Inc., Thomas B. Markley, and Robert T.
