Plaintiff, Robert Cooper, moved this Court for partial summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. On October 28, 1994, this Court denied the motion from the bench and dismissed the case without prejudice for lack of federal jurisdiction.
