Pending before the Court is the motion of the defendant San Con, Inc. (San Con) to disqualify Daniel A. Ruley, Jr. and the law firm of Steptoe & Johnson as counsel for the plaintiffs Roberts & Schaefer Company (Roberts & Schaefer) and Mingo Logan Coal Company (Mingo Logan).
