LATTIMORE, Justice.

Appellant Gerald Scott Cotten was convicted by a jury of the offense of burglary of a habitation. See Tex.Penal Code Ann. § 30.02 (Vernon 1994). The jury assessed punishment at ten years' confinement in the Institutional Division of the Texas Department of Criminal Justice, probated for ten years, and a $5,000 fine.
