This case comes before the court on Defendant's motion to dismiss Count One of the indictment filed against him on December 1, 1992, in the Middle District of North Carolina. Defendant claims the indictment charges him with the same conspiracy to which he pled guilty in Tampa, Florida, in 1986, and therefore the North Carolina indictment should be barred by the Fifth Amendment's double jeopardy clause.
