This case stems from a roofing contract gone awry. Although the contractor—defendant Wallace Galbreath—initially pleaded guilty to theft by misappropriation, he later decided the plea was ill-advised. He moved in arrest of judgment but the district court denied the motion. Upon defendant's appeal, the case was transferred to the court of appeals.
