Following a jury trial, appellant was convicted of one count of first-degree murder while armed (D.C.Code §§ 22-2401, -3202 (1989)) and one count of carrying a pistol without a license (CPWL) (D.C.Code § 22-3204 (1989)). Subsequently, the trial court denied without a hearing appellant's motion for a new trial based on a claim of newly discovered evidence.
