This case came before the Supreme Court on appeal by UXB Sand & Gravel, Inc. (UXB), from a judgment of the Superior Court that granted the motion of Rosenfeld Concrete Corporation, Judith P. Parker, D. Barry Parker, and Myrtle Elizabeth Price (defendants) for a directed verdict and granted the defendants' subsequent motion for a new trial.
