I. INTRODUCTION

On November 25, 1988, the petitioner filed a petition for a writ of habeas corpus under 28 U.S.C. § 2254. The petitioner and a co-defendant, Gregory Resnover (hereinafter Resnover) were convicted of murder and conspiracy to commit murder in the shooting death of Indianapolis policeman Jack Ohrberg ("Ohrberg").
