BERTELSMAN, Chief Judge:

I. INTRODUCTION

This is a civil rights action, pursuant to 42 U.S.C. § 1983, to recover damages for the death of Donald Scott Baker (hereinafter referred to as "Scotty"), a minor. Plaintiffs also assert supplemental state law claims. The action was filed against Charlotte H. Smith, the school secretary who released Scotty into the hands of his stepmother and an accomplice who murdered him....
