The issues raised by this appeal concern the district court's granting of a summary judgment motion filed by Mimbres Memorial Hospital and Nursing Home (Defendant). Plaintiffs, Celia Diaz and Ramon Diaz, Sr., both individually and as guardians and next friends of Ramon Diaz, Jr., brought suit claiming personal injury based on medical malpractice pertaining to the birth of their son.
