This case comes before this court on plaintiff's motion for an award of attorney's fees and costs under 28 U.S.C. § 2412 (the Equal Access to Justice Act ("EAJA")).1 Having considered the memoranda and evidence of both parties, this court shall grant plaintiff's motion.
