On March 7, 1988, respondent Harold Kenneth Shively ("Shively") sought Medicaid benefits for his mother, Grace Shively ("Grace"), from appellant State of Nevada, Department of Human Resources, Welfare Division ("NSWD"). Shively was acting as Grace's personal representative.
