REYNOLDS, Justice.

Logan Circuit Court, by order, suppressed evidence of Jeffery Canler's confession upon the indictment against him for criminal abuse in the first degree. (KRS 508.100). The order upheld the constitutionality of the statute. Two judges of the Court of Appeals' panel reversed the order of Logan Circuit Court and held the confession admissible.
