In April of 1989, Aaron B. Fodge, Sr., was found guilty by a jury of lewd and lascivious conduct with a minor under the age of sixteen. I.C. § 18-1508. The district court sentenced Fodge to life in prison with a minimum period of thirty years' confinement. Fodge initially appealed his conviction to the Idaho Supreme Court.
