The plaintiff in this adversary proceeding lost over $4 million when an unscrupulous aluminum broker set up phony transactions, diverted aluminum from the plaintiff's intended customers, and failed to pay for goods delivered. The plaintiff now claims that the carrier of the aluminum, and the warehouse in which it was stored, should be held liable for the loss based upon their failure to honor the original bills...
