This case is a breach of contract case arising out of a flood insurance policy between Allan J. Smietanka and Virginia Smietanka ("the Smietankas") and the Federal Emergency Management Agency ("FEMA"). The case is now before the court on FEMA's Motion for Summary Judgment, pursuant to Rule 56 of the Federal Rules of Civil Procedure.
