Plaintiffs' original complaint alleged that defendant Robert L. Kassel violated the Commodity Exchange Act and committed common law fraud and misrepresentation. Jurisdiction was premised on federal question jurisdiction. See 28 U.S.C. § 1331. The Court dismissed the claim brought pursuant to the Commodity Exchange Act and, accordingly, ordered plaintiffs to file an amended complaint articulating a new basis...
