Five-year-old Michael C. Frances suffered a cardiac arrest secondary to drowning and died on November 23, 1988. Linda Frances, individually and as guardian ad litem for her three minor children (at the time of the filing of the complaint, Michael was still alive), filed an action against respondent, Plaza Pacific Equities, Inc.
