Pending is Defendant's motion for summary judgment pursuant to Rule 56(c). The Court concludes that genuine issues of material fact remain. Accordingly, Defendant's motion is hereby DENIED in part. The Court GRANTS Defendant's motion relating to Plaintiff's First Amendment claim.
