Plaintiffs brought this action pursuant to 29 U.S.C. § 185 (§ 301 of the Labor Management Relations Act), alleging that their employer, Jack Cooper Transport (hereafter "Employer") breached a collective bargaining agreement, and that the International Brotherhood of Teamsters (hereafter "Union") breached its duty of fair representation.
