The City of North Charleston (the City) commenced a condemnation proceeding against landowners Janie and William Claxton (the Claxtons). The Claxtons requested a jury trial to determine the value of the condemned property. The jury returned a verdict for the Claxtons for $79,500. The City made a motion for new trial nisi and the Claxtons moved for an award of attorney fees. The trial judge denied the motion for new trial and awarded the Claxtons $17...
