PAPADAKOS, Justice.

This is the appeal of Ernest Singletary (Appellant) from the opinion and order of the Superior Court reversing the order of the Court of Common Pleas of Lycoming County which granted summary judgment in favor of Appellant and remanded the matter to the trial court for further proceedings.
