MOODY, District Judge.

This matter is before the court for resolution of the pro se, incarcerated defendant's "Motion Under 28 U.S.C. § 2255 to Vacate, Set Aside, or Correct Sentence by a Person in Federal Custody." The government responded pursuant to the court's order under Rule 4(b) of the § 2255 Rules, and the defendant replied.1
