On July 12, 1990, a one count indictment was returned against Michael David Butler, charging him with possession of an unregistered sawed-off 12-gauge shotgun in violation of 26 U.S.C. §§ 5845(a)(2), 5861(d) and 5871. On May 22, 1991, Defendant entered a conditional plea of guilty under Fed.R.Civ.P. 11(a). Defendant was sentenced on August 14, 1991, to a period of 18 months incarceration, three years of supervised release...
