This matter is before the court on the plaintiff's motion for summary judgment pursuant to Rule 56(a) of the Federal Rules of Civil Procedure. The motion was filed on July 8, 1992. Defendant has filed a memorandum of law in opposition to the plaintiff's motion, and the plaintiff has filed his reply. The matter is now ripe for disposition.
