Presently before the court is defendant E.I. DuPont de Nemours and Company's ("DuPont") motion to dismiss the complaint of plaintiff Tersco, Inc. ("Tersco"). For the reasons set forth below, the court will dismiss with prejudice count one of the complaint only insofar as it asserts a claim for breach of an implied covenant of good faith and fair dealing and seeks punitive damages.
