Charles Raymond Whitehead was indicted for the offense of unlawful distribution of the controlled substances methylphenidate and hydromorphone, in violation of § 13A-12-211, Code of Alabama 1975.

On October 31, 1990, the prosecution filed a motion to consolidate three other cases pending against Whitehead with the present offense. At the hearing on this motion, the prosecution withdrew its request to consolidate one...
