The defendant, Coatesville Electric Supply Co., has filed a Motion to dismiss pursuant to Fed.R.Civ.P. 12(b)(6), or, in the alternative, for summary judgment pursuant to Fed.R.Civ.P. 56(c). For the reasons set forth below, the plaintiff's claim will be dismissed with leave to amend within thirty days.
