This matter is before the Court on defendants' motion for summary judgment. In this 42 U.S.C. § 1983 case, all named defendants concede that they were acting under color of state law. Defendants also concede that plaintiff Marshall Draper suffered a deprivation of constitutionally protected liberty and property interests.
