MEMORANDUM OPINION AND ORDER

HAIGHT, District Judge:

In this action for copyright infringement with common law claims appended, defendant moves under Rule 12(b)(6) to dismiss the complaint, or in the alternative for partial summary judgment under Rule 56 limiting the amount of plaintiffs' damages. Plaintiffs cross-move for summary judgment on the issue of liability.
