The Court has before it plaintiff Nike International's Motion for Summary Judgment on the Fourth Claim for Relief and defendant Venrod's Opposition thereto. Defendant Athletic Sales Inc. ("ASI") is judgment proof and thus has not filed a response to Nike's Motion.
