The dispositive issue of this motion to dismiss the appeal is whether the timely filing of a motion to reargue tolls the running of the appeal period. We conclude that it does.

The facts are not in dispute. This is a breach of contract action in which judgment was rendered for the defendant on January 3, 1991. On the following day, the plaintiff filed a motion to reargue, which was heard and subsequently denied on January 22, 1991. On February 4,...
