The issue in this appeal is whether a jury could find defamatory an article appearing in a daily newspaper which contrasted the newspaper's decision to publish a photograph of school directors who were smiling as they left a district justice's office after some of them had been found guilty of violating the Pennsylvania Sunshine Law, and the publication of a photograph of hardened criminals who smile to show contempt of the law.
