PER CURIAM:

Duane Baldwin was convicted in Southwest District Court of minor in possession. His conviction was affirmed by the King County Superior Court on RALJ appeal. He then sought discretionary review in this court. On May 21, 1991, Commissioner Hudgins granted discretionary review of one of the issues raised by Baldwin. The case has been referred for a decision on the merits. We reverse Baldwin's conviction.
