Dr. Nicola DiPalma was injured on July 17, 1985 at Lincoln Greyhound Park in Rhode Island when he fell after the escalator on which he was riding shuddered or jolted. Dr. DiPalma then brought suit against Westinghouse Electric Corporation (hereinafter, defendant-appellee) as manufacturer and maintenance contractor.
