MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

Defendant Carlos Quintanilla, Jr. has filed a motion under Federal Rule of Civil Procedure 60(b)(4) for relief from the default judgment entered against him on March 29, 1991. Quintanilla contends that this court lacked jurisdiction over the complaint brought by plaintiff Kenneth G. Mason, and thus the default judgment is void.
