The instant appeal arises out of an action to recover damages for injuries suffered by a painter who fell while painting a house. The trial court determined that the painter, Greg Furtado, was an employee of the homeowner, Kent Schriefer, and therefore exclusive jurisdiction of the matter lay with the Workers' Compensation Appeals Board. The trial court retained jurisdiction over the matter, but stayed the proceedings...
