This action was tried before me without a jury over six days in October and November 1989. Plaintiff, a student at the New York State University at Albany,1 attacks as unconstitutional the allocation to the New York Public Interest Research Group ("NYPIRG"), of $3 from his $53 mandatory student activity fee payable each semester.
