This case is before the Court on Plaintiff's Motion to Dismiss Defendant's Counterclaim and Plaintiff's Motion to Dismiss Defendant's Amended Counterclaim. Plaintiff claims that Defendant's counterclaim is not a proper recoupment claim and, accordingly, should be dismissed.
