This case is before the court on the defendant's motion for summary judgment as to each count of plaintiff's three-count complaint. Count 1 claims benefits under certain policies of insurance, Count 2 seeks damages for alleged bad faith refusal to pay benefits, and Count 3 alleges fraud and misrepresentation.
